How we handle your personal data
Simplexity collects personal data only when the visitor provides it voluntarily through forms, email, WhatsApp, calls, demos or commercial interactions. We use that data to respond to requests, prepare assessments, coordinate demos, deliver contracted services, provide support and comply with legal obligations.
Data we may collect
- Name, company, role, email, phone or WhatsApp.
- Country, operational volume, type of service of interest and the message sent.
- Information needed for demos, assessment, implementation or support.
- Minimal technical form metadata: date, source page, language and accepted policy version.
Purposes
- Respond to an inquiry or contact request.
- Coordinate demos, assessments, pilots, proposals or services.
- Send communications related to the request received.
- Send commercial communications only when consent exists or a permitted prior commercial relationship applies.
- Improve security, traceability, customer service and legal compliance.
Rights of the data subject
You may request access, rectification, update, revocation, objection or deletion of your data by writing to info@simplexityla.com or using the support channel. We will verify the requester's identity before making changes.
Transfers and processors
We may use technology providers for hosting, email, analytics, forms, support, messaging, automation or AI. Where applicable, those providers act as processors or subprocessors and must handle data according to instructions, security and legitimate purpose.
Retention
We keep personal data only for as long as necessary to fulfill the purpose for which it was collected, to manage the resulting commercial relationship, and to comply with legal, accounting or tax obligations. Contact requests that do not lead to a relationship are deleted or anonymized once they are no longer needed, or earlier upon a valid deletion request.
Supervisory authority
This processing is governed by Costa Rica's Law 8968 on the Protection of the Person against the Processing of their Personal Data. In addition to contacting us, you have the right to file a complaint with the Agency for the Protection of Data of Inhabitants (PRODHAB).
Use of the site, demos and digital services
The Simplexity website provides commercial information about consulting, technology implementation, automation, applied AI and vertical platforms. The site information does not constitute a final contractual offer until a proposal, contract, service order or express commercial acceptance exists.
Demos, pilots and trials
- Demos show reference capabilities and may run on fictitious data or test environments.
- The terms of pilots, free trials, usage limits, support, duration, price, taxes, renewal and cancellation will be documented in the applicable proposal or contract.
- When a page states “no card”, “free trial” or “no commitment”, there will be no automatic charge without express acceptance of commercial terms.
Permitted use
The site, demos or services may not be used for unlawful purposes, to infringe third-party rights, upload data without authorization, bypass security controls, automate abuse, send spam or attempt to access unauthorized systems.
Informational limitation
Content about SAR, Hacienda, health, education, hospitality, logistics or AI compliance is technological and commercial guidance. It does not replace specialized legal, tax, medical, educational or accounting advice.
Governing law and jurisdiction
These terms and the use of the site are governed by the laws of the Republic of Costa Rica, including Law 10946 on the Governance of Digital Services and E-Commerce and Law 7472 on consumer protection. Any dispute will be submitted to the competent courts and authorities of Costa Rica, without prejudice to the consumer's rights before the National Consumer Commission.
Applied AI, sensitive data and human review
Some Simplexity products may process operational, commercial, educational, hospitality, logistics, tax or health data depending on the contracted use case. When AI is used, we will document the purpose, data types, limits, providers, security measures, retention and client responsibilities.
Protection rules
- Minimization: only data necessary for the agreed purpose will be requested.
- Separation: demos must use fictitious or anonymized data unless expressly authorized.
- Human review: sensitive decisions must not rely solely on AI without human validation.
- Confidentiality: data of clients, patients, students, guests, billing or documents will be handled under reinforced controls.
- Deletion: the client may request deletion or export of data in accordance with the contract and legal obligations.
Formal channel for claims, support and requests
Simplexity maintains a support and claims channel for users, prospects and clients. You can start a request through the support portal, email or WhatsApp. The recommended formal channel is the support portal for traceability.
What to include
- Name, company, email and contact phone.
- Related product or service.
- Description of the claim, evidence, dates and expected outcome.
- If it relates to personal data, indicate the right you wish to exercise.
Process
- Receipt of the request and case registration.
- Identity or service-relationship validation where applicable.
- Internal analysis and response through the same channel or agreed means.
- Escalation when the case involves personal data, security, billing, platform or contract.
External recourse
Using our channel does not limit your rights. As a consumer you may also file a complaint with the National Consumer Commission of the Ministry of Economy, Industry and Commerce (MEIC) under Law 7472 and Law 10946; for personal-data matters, with PRODHAB under Law 8968.
